Terms & Conditions
Welcome to Gaijin Travels (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, digital travel guides, digital menu pages, QR services, and related offerings (collectively, the “Service”).
By accessing our Service, creating an account, or registering as a merchant partner, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
1. Overview of Services
For Travelers / Visitors: We provide a digital travel directory, store pages, translated menus, access guides, and local recommendations across Japan.
For Merchants / Hosts: We provide platform listing services, English digital store page creation, media hosting, and translation display services.
Third-Party Intermediary: The Company acts solely as an informational platform and promotional intermediary. We do not own, manage, or operate the restaurants, shops, tours, or venues listed on our Service.
2. Merchant & Host Terms (B2B)
2.1 Content & Translation Accuracy
Merchants are solely responsible for providing accurate photos, pricing, allergen warnings, menu items, opening hours, and business details.
While the Company uses reasonable care (and software translation tools) to translate merchant content into English, the merchant remains responsible for reviewing and confirming the final localized page.
The Company is not liable for customer disputes, dietary misunderstandings, or losses resulting from translation inaccuracies provided in good faith.
2.2 Free Trials & Subscriptions
Free Trial: If offered, new merchants receive a one (1) month free trial starting from the page activation date.
Subscription & Renewal: Unless canceled prior to the end of the trial period, subscriptions roll over into monthly auto-renewing billing cycles.
Cancellation: Merchants may cancel their subscription at any time via email, LINE message, or account dashboard. Cancellations take effect at the end of the current paid billing cycle.
2.3 Licensing & Intellectual Property
Merchants grant the Company a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and adapt their business name, logos, menu photos, and store photos strictly for the purpose of running and marketing the Service.
The Company retains all legal rights, title, and ownership in the software, design, code, branding, and platform architecture.
3. Traveler & User Terms (B2C)
3.1 Information Accuracy
While we strive to keep local guides up to date, information regarding menu prices, availability, dietary options, operating hours, and booking conditions is subject to change without notice by the respective merchant.
Users are advised to double-check critical details (such as severe food allergies) directly with shop staff upon arrival.
3.2 Direct Transactions
Any purchase, dining order, or activity booking made at a merchant venue is a direct transaction between the user and the third-party merchant. The Company is not a party to those transactions and bears no liability for service quality, food safety, or cancellations.
4. Prohibited Activities
When using our Service, you agree not to:
Provide false, misleading, or deceptive business information.
Copy, scrape, reverse-engineer, or duplicate platform content, code, or digital menu structures without written consent.
Use the platform to send unsolicited promotional material (spam) to listed merchants.
5. Limitation of Liability
To the maximum extent permitted by applicable law:
AS-IS Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
Indirect Damages: The Company shall not be liable for any indirect, incidental, special, or consequential damages (including loss of revenue, business interruption, or customer dissatisfaction) arising from the use of our platform or third-party venue visits.
Liability Cap: In all cases, the Company’s total aggregate liability to any merchant or user shall not exceed the total fees paid by that party to the Company during the three (3) months preceding the claim.
6. Service Availability & Termination
We reserve the right to temporarily modify, suspend, or discontinue any part of the Service for maintenance, security updates, or technical upgrades.
We reserve the right to terminate access or remove merchant listings immediately if a party breaches these Terms, engages in fraudulent behavior, or provides unlawful content.
7. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan (or, if registered elsewhere prior to Japanese establishment, the laws of your jurisdiction of incorporation). Any legal disputes shall be subject to the exclusive jurisdiction of the regional courts in Japan.
